"It is said an Eastern Monarch once charged his wise men to invent him a sentence to be ever in view, and which should be true and appropriate in all times and situations. They presented him the words 'And this, too, shall pass away.' How much it expresses! How chastening in the hour of pride! How consoling in the hour of affliction!" The Collected Works of Abraham Lincoln, edited by Roy P. Basler, Volume III, "Address Before the Wisconsin State Agricultural Society, Milwaukee, Wisconsin" (September 30, 1859), pp. 481-482.
The Bill of Rights of The Constitution of the United States lays the foundation of greatness for our Country. It guarantees us certain personal freedoms and limits the oppressive power of our government. One of those guaranteed rights is the right to effective representation in the event we are accused of a crime. As trial lawyers, we consider it a sacred trust to protect that right.
Often we find that a client can greatly assist us in winning their case if they are aware of their constitutional rights before they are arrested or charged. This is why it is essential that you go to Your Rights if Questioned, Stopped or Arrested by the Police by clicking on this link or going to our library page. We have had many cases dismissed by filing the appropriate motion because a client knew what to do at a crucial time.
Edward DiCato is a criminal trial attorney with over fifteen years of experience and dozens of criminal trials. Though mostly handling felony cases, Mr. DiCato has significant experience in municipal court, especially defending charges of driving while intoxicated, driving under license suspension and misdemeanor drug offenses. A partial list of some of the felony cases that have been defended by Mr. DiCato are drug cases (from trafficking in large quantities to simple possession), rape, burglary, robbery, felonious assault, assault, attempted murder, theft, fraud, domestic violence, assault on a police officer, resisting arrest, felony DUI, cases prosecuted under the Ohio Racketeering Statutes and many other felony cases ranging from first degree felonies to fifth degree felonies. Mr. DiCato has been successful at bringing many motions for Judicial Release. Mr. DiCato has also been successful at defending probation violations, keeping his clients from being sent back to the penitentiary after violating the terms and conditions of their probation.
We do not practice criminal law to become "friends" of the police and prosecutors. We represent your interests in the courtroom and will take whatever legal measures we feel will best serve those interests. Whether that be a trial by jury, filing particular motions, or the acceptance of a plea negotiation, we will fully discuss the case with you, give you all available facts along with our opinions and suggestions, and let you make the final decision as to what course of action shall be taken. We will not pressure you into any course of action to which you are opposed. We will answer all of your questions and give you counsel and advice based on our knowledge and experience to lead you toward the best course of action for your particular problem. Many clients choose to go to trial and in many cases that is the best course of action.
