Traffic Laws

Many traffic violations do not justify the use of a lawyer.  If you get a speeding ticket, and you are guilty, just go pay the fine and get it over with.  There are exceptions to this, even if you get a simple speeding ticket.  For instance, each traffic offense has a number of "points" attached to it.  These points accumulate until they are over two years old, at which time they drop off.  If you reach twelve points in a two-year period, then you will get a six-month license suspension.  So, if that ticket you just got is going to push you over the twelve-point limit, you may want to consult an attorney to see if something could be done to avoid the suspension.

Another reason you may want to avoid being convicted of a traffic offense is as follows.  Suppose that you are in an accident and you are the party given the ticket.  You may be liable for all of the other driver's injuries and being convicted of even the most minor driving offense  could later be used to help show that you are responsible for the accident.  Most of the time, if you are responsible, your insurance will pay for the other drivers injuries.  However, you might not have enough insurance to cover the injuries, or you may have your own injuries for which you don't have insurance, or you may just be convinced that the accident wasn't your fault.  These are all reasons to get legal advice. IMPORTANT!  See the pamphlet entitled TRAFFIC ACCIDENTS in the library for a discussion of what you should do if you are involved in an accident.

Finally, the offense itself may carry some very serious potential penalties.  For example DUS (driving under suspension) or DUI (driving under the influence of alcohol or drugs) both carry maximum sentences of six months in jail and $1000 in fines.  If you are being charged with either one of these offenses, you should definitely consult an attorney.  Take advantage of our free initial consultation if you have questions about your case.  You can get phone, fax, and e-mail information from the Contacts Page  or use the Online Consultation Page
