Every final decision of most Courts and some State Agencies in Ohio are subject to review in an Appellate Court.  For practical purposes, Summit, Wayne, Lorraine and Medina Counties fall under the jurisdiction of the Ninth District Court of Appeals.  Decisions rendered by the Ninth District Court are subject to review by the Supreme Court of Ohio (and sometimes by the Federal Court System).

By far, the most common type of cases before the Ninth District Court are the final decisions of either the Municipal or Common Pleas Courts located in the above listed counties.  These cases are presented to the Ninth District Court by filing a Notice of Appeal with the Clerk.  Appellate Court rules establish the time frames and circumstances which govern the filing of the Notice of Appeal.  One important rule governing the filing of this Notice  is that civil cases can be reviewed only at the discretion of the Court, while the Court cannot refuse to review criminal cases, which are reviewed as a matter of right.

There are no juries or witnesses at the Court of Appeals; however, they do hear oral arguments to allow the parties to present to the judges, in person, the legal arguments in their case.  Cases are reviewed  to be certain no legal error occurred, this requires the examination of transcripts and exhibits from the trial court a well as legal briefs prepared by the attorneys or parties involved in the appeal.

Mr. DiCato has a great deal of experience in appellate work, especially in the Ninth District Court.  Bringing successful appeals requires in depth knowledge of general principles of law and the specific legal issues relevant to your case.  Training and experience are especially important when working in this highly complex area of legal practice.  In the past, we have succeeded at getting a high percentage of cases either reversed or sent back to the trial court for rehearing.  Take advantage of our free consultation to review your case and answer any questions you may have.
